How many properties may I sell privately?

A sale of 3 properties within 5 years can lead to the establishment of a commercial property trade. This is only the case if there is also a close temporal connection between the acquisition of the properties and their sale. If a property is acquired or constructed or modernised and resold within five years, it is assumed that it has already been acquired with an intention to sell (close temporal connection). The property is then normally counted towards the “3-property limit”. A sale is then no longer private.

When should you sell real estate?

For a rented property, in the best case, after it has been owned for 10 years. In the case of a property that has been used exclusively for one’s own residential purposes, the time of sale does not matter.

How many properties can you sell tax-free?

If land has been rented out, leased or used by the owner for more than 10 years, a sale is always irrelevant for tax purposes. There is no maximum limit here.

When can you sell real estate tax-free?

If they have been rented or leased for more than 10 years, or have been used exclusively for own residential purposes in the period between acquisition or completion and disposal, or for own residential purposes in the year of disposal and the two preceding years.

If the period between acquisition and sale is more than ten years, there is generally no close temporal connection. In these cases, there is no assumption that the properties were already acquired with the intention to sell. If properties have been rented, leased or used by the owner for more than 10 years, a sale is always irrelevant for tax purposes. Moreover, they are not counted in the 3-property limit.

Irrespective of the question of commercial property trading, it is necessary to determine the capital gain and tax it when selling a property if there are less than ten years between acquisition or production. This is then a private disposal transaction pursuant to Section 23 (1) EStG.

The only exception to this is real estate that was used exclusively for own residential purposes in the period between acquisition or completion and sale or for own residential purposes in the year of sale and the two preceding years.
